1. The defendant shall receive KRW 5,000,000 from the plaintiff at the same time, and the attached Form among the buildings listed in the attached Table shall be attached to the plaintiff.

Reasons

1. The following facts are not disputed between the parties, or may be acknowledged in full view of the purport of the entire pleadings in each entry in Gap evidence Nos. 1 through 5:

(1) On October 26, 2006, the Seoul Special Metropolitan City Mayor publicly notified the Seoul Jongno-gu Seoul Metropolitan Government public notice of the designation of the E urban renewal acceleration district as to the area of 438,560 square meters, including the area where there is a building listed in the attached list owned by the Plaintiff (hereinafter “instant building”).

⑵ 원고와 피고는 2014. 4. 10.경 이 사건 건물 중 별지 도면 표시 ⑴, ⑵, ⑶, ⑷, ⑸, ⑹, ⑺, ⑻, ⑼, ⑽, ⑴의 각 점을 차례로 연결한 선내 ㈎부분 16.53㎡(이하 ‘이 사건 계쟁부분’)를 원고가 피고에게 임대하기로 하는 임대차계약(이하 ‘이 사건 임대차계약’)을 체결하였고, 피고는 그 무렵부터 이 사건 계쟁부분을 인도받아 사용하여 왔다.
