A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
[2] On June 12, 1997, the Defendant was sentenced to 12 years of imprisonment with prison labor for special larceny, etc. at the Daegu District Court and its branch court, on June 15, 2010, sentenced to one year and eight months of imprisonment with prison labor for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Daegu District Court on April 26, 2012. On January 12, 2015, the Defendant was sentenced to two years and six months of imprisonment with prison labor for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes in the Daegu District Court and its branch court, and completed the execution of the sentence at the prison on December 22, 2016.
[Criminal facts]
1. On September 15, 2017, at around 13:00 on September 15, 2017, the Defendant: (a) committed habitual theft and intrusion on a house; (b) committed an intrusion upon the victim’s residence by inserting and sucking out the dracker between the windows of the corrected living room in front of the victim D’s house; and (c) resulting in a theft of the cash amounting to KRW 200,000,000 owned by the victim in TV from that place to November 21, 2017; and (d) stolen the property amounting to KRW 30,160,000,000 in total nine times in total, as in the list of crimes in the attached Form 1).
Accordingly, the defendant invadedd the victims' residence and stolen the victims' property habitually.
2. On November 11, 2017, the Defendant: (a) attempted habitual larceny and intrusion upon residence; (b) opened a studio door in front of the victim F’s house in Kimcheon-si, Kimcheon-si, and opened a studio door, which was not corrected; (c) intrudes the victim’s residence; and (d) intrudes the victim’s residence at that place; and (d) stolen money and valuables at that place, but attempted to flee with the wind that was discovered to the victim, but escaped; and (e) was committed by the same similar method as in the attached Table 2 of Crimes List 2 from November 21, 2017 to November 21, 2017.
Accordingly, the defendant attempted to steal the victims' property habitually and habitually.
