Reasons
1. Basic facts
A. The parties’ relevant net A (hereinafter “A”) is a person who served as the representative director of Nonparty F Co., Ltd. (hereinafter “F”) at the time of 2006, and Nonparty G is a person who served from April 2001 to September 2005 as the representative director of Nonparty H Co., Ltd. (hereinafter “H”). The Plaintiff is a person who served as the representative director of Nonparty A Co., Ltd. (hereinafter “H”) at the time of 2006 on the post-line relationship with G and high-speed line, and the Plaintiffs are the successors.
B. G, etc. and Busan Urban Corporation (hereinafter “instant project site”) H is the project site of this case between J 1,2 block 23,429.1 square meters in Nam-gu, Busan and JJ (hereinafter “YJ”).
(2) On May 18, 2004, the Plaintiff purchased the instant project site between G and Nonparty Busan Urban Corporation (hereinafter “instant sales contract”).
(2) On June 7, 2005, G and H (hereinafter “G, etc.”) concluded a contract for transfer and takeover of business rights with the content of transferring the purchaser’s status under the instant sales contract and any business rights incidental thereto to the G, etc. (hereinafter “Korea Coastal Construction”) on June 7, 2005.
3) On October 4, 2005, G et al. notified G et al. of the cancellation of the instant sales contract, which did not pay intermediate payments and remainder under the instant sales contract, notwithstanding the grace period several times, and H & Han Urban Corporation filed an application against Busan Urban Corporation for provisional disposition prohibiting disposal of the instant project site, and received a provisional disposition order as Busan District Court Decision 2005Kahap2484 on October 31, 2005.
H on September 15, 2006, the Busan District Court 2006Gahap16775, filed a lawsuit for the registration of ownership transfer with respect to the pertinent project site. However, the above court dismissed all of the claims for H and Han Dam Construction, and the Busan High Court 2007Na2062, the appellate court of the above case.
