1. Defendant B’s building management committee shall pay to the Plaintiff KRW 10,726,858 and its related amount from August 4, 2012 to the date of full payment.
Reasons
1. Basic facts
A. The relationship 1) The Plaintiff is a corporation that mainly engages in the comprehensive building management business, and Defendant B Building Management Committee (hereinafter “Defendant B Building Management Committee”).
B and its affiliated facilities, which are Gangseo-gu Seoul Metropolitan Government F ground condominiums (hereinafter referred to as “instant building”).
(2) Defendant C is the managing body of the instant building. (2) Defendant C is the sectional owner of the instant building and the representative of the Defendant Building Management Committee, and Defendant D is the Plaintiff’s employee from December 2009 to January 2012, and was employed by the Defendant Building Management Committee from January 2012 to work as the managing body of the instant building. Defendant E is the person who was living in this context by leasing the instant building 413 and is in charge of the representative of the Defendant Building Management Committee.
B. On July 2009, the Plaintiff entered into a building management service agreement with the Defendant Building Management Committee and the Defendant Building Management Committee to entrust the Plaintiff with the management of the instant building from August 1, 2009 to July 31, 201, and to pay KRW 18,895,922 per month at service cost (hereinafter “instant service agreement”).
The main contents of the instant service contract are as follows.
Article 6 (Payment of Service Fees)
1. B shall notify a claim for the general management expenses of KRW 1.152 per parcel of land owned by owners and occupants, and deposit such expenses, and cope with the expenses for building management services;
Article 7 (Management Expenses)
1. B shall notify the amount of management expenses each month from 1 to 30 days before the 7th day of the following month and pay it by the 15th day of the following month; and
3. Management expenses shall be collected by settling accounts on a monthly basis; and
A notice of collection of management expenses (distribution of a notice of management expenses) shall be distributed at least five days prior to the deadline for payment.
