[Defendant A] The defendant shall be punished by imprisonment with prison labor for a year and two months.

[Defendant B] The defendant shall be punished by imprisonment with prison labor for one year

(b).

Punishment of the crime

No person shall transfer or take over, or arrange for the transfer or acquisition by transfer of, or advertise for the purpose of arranging the transfer or acquisition by transfer of, a deed or status equivalent to the status to supply, or for the purpose of arranging for, the supply of housing constructed and supplied under the Housing Act.

1. Defendants A and B conspired on April 2016 at the mutual infinite coffee shop located in Gangdong-gu Seoul Metropolitan Government, and Defendant B recruited E in the name of the head of the Tong subscribed for Housing through the advertisement. Defendant A arranged E to transfer to C the data that can be subscribed under the name of E, such as the head of the Tong subscribed for Housing in the name of E after having attempted to purchase the said head of the Tong, and then received KRW 2,00,000 from the above C in return for the transfer of the data that can be subscribed for in the name of E, such as the head of the Tong subscription for Housing in the name of E, and then arranged for transfer of the certificate or status that can be supplied over 18 times in total, as described in the attached list of crimes, from around that time to July 23, 2018.

As a result, the Defendants conspired to arrange the transfer of the certificate of comprehensive savings for house subscription.

2. On October 2016, the Defendant: (a) requested G to transfer to C data that can be subscribed in the name of G, such as the passbook in the name of the head of Tong in the name of the Si/Gun/Gu in Seongbuk-gu, Sungnam-si; and (b) received KRW 5 million from the above C for the consideration thereof.

As a result, the defendant arranged the transfer of the deed of the comprehensive savings for subscription for house.

3. Defendant B

A. On June 7, 2018, the Defendant’s act of advertising the purpose of acquiring the passbook for the comprehensive savings subscribed to a house was attached to an advertisement site stating “the head of the Tong, subscription savings, deposits, deposits, general passbooks, friendship counseling, I real estate, and J” on the glass of the vehicle parked in a pel in the vicinity of the Sung-nam-gu Si, Sungnam-gu.

Accordingly, the defendant is a certificate that corresponds to the status of supplying a house.
