1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. The Plaintiff’s assertion on December 2013 lent KRW 40,000 to the Defendant and agreed to pay KRW 300,000 per month interest. By October 2017, the Plaintiff’s allegation reached KRW 5,520,000.
Therefore, the defendant should pay damages for delay calculated by the rate of KRW 300,000 per month from November 1, 2017 to the day of full payment of the principal amount of KRW 45,520,000 and KRW 40,000 among the principal amount of KRW 40,000.
2. According to the evidence No. 1-1 and No. 2 of the judgment, the fact that the Defendant paid to the Plaintiff KRW 180,00 each month from January 6, 2014; January 17, 2014; February 17, 2014; March 17, 2014; May 9, 2014; and July 14, 2014; KRW 600,000 each; KRW 300,000 on October 15, 2014; and KRW 180,000 each month from November 19, 2014 to October 24, 2017.
However, the above facts alone are difficult to recognize that the Plaintiff lent KRW 40,000 to the Defendant, and there is no other evidence to prove otherwise.
3. If so, the plaintiff's claim of this case is dismissed as it is without merit.
