1. Of the distribution schedule prepared on June 4, 2013 by the above court with respect to the case of compulsory auction by Gwangju District Court C real estate.
Reasons
1. Basic facts
A. After completing a marriage report with D on February 22, 1985, the plaintiff was living together with D on February 1, 2002, after purchasing from E the F apartment 207-dong 104 (hereinafter "the apartment of this case") of Gwangju Nam-gu from 78,00,000 won, and completing a move-in report on February 22, 2002, the transfer registration of ownership on the apartment of this case was completed in the name of D on February 25, 2002.
B. D filed a divorce lawsuit against the Plaintiff on February 3, 2005, when the Plaintiff’s sexual assault, etc. led to the Plaintiff’s marriage life, and on April 14, 2006, the Plaintiff and D were sentenced to a judgment of divorce from the Gwangju District Court branch on April 14, 2006. After the said judgment became final and conclusive, D filed a divorce report on May 26, 2006.
C. On January 31, 2011, the Plaintiff drafted a lease agreement from D to lease the instant apartment with a period of KRW 80 million from January 31, 201, or from January 31, 201 to 24 months from the lease period, and obtained a fixed date on February 21, 201.
On July 4, 2011, the Defendant received a provisional attachment decision of KRW 200 million with respect to the instant apartment, and completed the registration of provisional attachment with respect to the instant apartment on October 5, 2012. On October 5, 2012, the Defendant sentenced that “D shall pay 5% per annum from August 5, 201 to October 5, 2012, and 20% per annum from the next day to the date of full payment,” and the said judgment was finalized on December 17, 2013.
E. On October 22, 2012, the Defendant applied for the commencement of compulsory auction on the apartment of this case in this court, and the decision to commence compulsory auction was made to this court C on the following day, and the entry registration was completed.
F. In the above auction procedure, the Plaintiff paid the purchase price of KRW 150 million on May 13, 2013, and received the bid of the instant apartment. This court on June 4, 2013.
