A defendant shall be punished by imprisonment with prison labor for not more than ten months and a fine not exceeding three hundred thousand won.

When the defendant does not pay the above fine.

Punishment of the crime

1. On June 1, 2018, the Defendant, at around 00:43, driven a motor device license (125C) with a section of approximately 250 meters from the street in front of the E travel company in Jeju, to the G restaurant in front of the G restaurant in Jeju, without a motor device license.

2. On June 1, 2018, the Defendant was driven under the influence of alcohol, such as smelling on the Defendant’s face and snicking on the front of a restaurant at around 00:54, and on the 112 report that the Defendant is driving under the influence of alcohol, the Defendant was driven under the influence of alcohol, such as drinking on the Defendant’s face from a police officer J, etc. belonging to the police station of the Jeju-dong Police Station 112, who called the Defendant.

There are reasonable grounds to determine a person, and thus, it was required to conduct a test by means of inserting the whole stage of the measurement by a drinking measuring instrument three times in order to put the breath of drinking over three times.

Nevertheless, the Defendant, by hand, failed to comply with a police officer’s request for alcohol testing without justifiable grounds, by keeping the police officer’s arms, keeping the police officer in secret, and evading the method of escape.

3. On June 1, 2018, around 00:57, the Defendant obstructed the performance of official duties, injured, or damaged property, on the street in front of the G cafeteria located in F at Jeju, and the police officers dispatched as stated in paragraph 2, refused to comply with the measurement of drinking without a driver’s license, and was arrested in a flagrant act under the suspicion of driving without a driver’s license under paragraph 1 and was on board the back of the 112 patrol.

On June 1, 2018, the Defendant, at around 01:00, responded to the above arrested arrest and walk the door of the patrol vehicle from the back seat of the patrol vehicle, and when the head was stuffed in the door, the Defendant was arrested by assaulting the victim's face by her hand from the private victim K (the remaining and 45 years old) around the police station in Jeju-dong police station, and the victim's face was removed from the private victim K (the remaining and 45 years old).
