피고인은 의사 및 한의사가 아님에도 불구하고, 2014. 8. 4.경 서울 금천구 D 아파트 101동 405호에 있는 모친 E의 거주지에서 침, 침통, 주사기, 주사기바늘, 부황기, 비타민주사액, 주사액통 등을 갖추어 놓고, 허리 통증등을 호소하는 F을 진맥한 후 발가락사이, 손등, 정수리 등의 부위에 침을 놓고 그 대가로 2만 원, 엉덩이 부위에 비타민 영양제(삐콤핵사) 주사를 놓고 그 대가로 1만 원을 받은 것을 비롯하여, 2007. 9.경부터 2014. 8. 11.경까지 사이에 매주 월요일은 위 장소에서, 매주 화요일은 부천시 소사구 G 다가구주택 2층에 있는 지인 H의 주거지에서 하루 평균 환자 20명을 진료하는 등, 영리를 목적으로 한방 및 양방 의료행위를 업으로 하였다.
