A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. [2019 Highest 1419] On January 10, 2019, the Defendant: (a) around 10:50 on the front of the Seoul Southern-gu Seoul Central District Office (hereinafter “Seoul Central District Court”); (b) reported as if he/she had faced with himself/herself and escaped; and (c) was willing to receive insurance money from the said passenger vehicle insurance company.

The Defendant reported 112 at the above date, time, and place to the effect that “C-tested vehicles face with one another, and they left the match.”

However, at the time of fact, the defendant was merely driving with the above car, and there was no difference between the above car and the car.

Accordingly, the defendant, as a driver of the car, was dismissed for the purpose of having D, who is a driver of the car, punished.

B. When the Defendant of the Special Act on Insurance Fraud Prevention came to know that the said car driver was D on January 16, 2019 by making a false report as above, the Defendant demanded D to accept the insurance and had D receive the insurance with the content that “A around January 10, 2019, as the insurance company for the said car, the Defendant would inflict a bodily injury upon the Defendant on the victim E, which is the insurance company for the said car.”

However, on January 10, 2019, the defendant was merely a mere intersection with the above passenger car and did not face the above passenger car.

On January 18, 2019, the Defendant, by deceiving the victim as above, received insurance proceeds of KRW 73,060 in the name of medical expenses, and KRW 1,500,00 in the name of the agreed amount, and KRW 1,573,060 in the name of the agreed amount.

2. [2019 Highest 2474] The Defendant, around 11:00 on January 28, 2019, will give money to the victim G, administered by the victim G in Jung-gu Seoul, Jung-gu, Seoul, with the victim’s clothes.

It refers to ‘the market price managed by the victim' and one of the color booms on the 40,000 won of the market price managed by the victim was stolen.
