1. Of the distribution schedule prepared on June 13, 2014 by the above court with respect to the case of the voluntary auction of real estate E by the Seoul Eastern District Court.
Reasons
1. Basic facts
A. On October 28, 2009, the Plaintiff: (a) obtained a voluntary decision to commence the auction of each of the instant real estate to the Seoul Eastern District Court E on June 25, 2013, and completed a registration of the said decision to commence the auction on the same day on the same day after receiving the registration of the voluntary decision to commence the auction on the same day, and as a result, the instant real estate was sold to H on April 28, 2014, to the Seoul Eastern District Court E on the instant real estate, under Article 7059, the maximum debt amount of KRW 1,00,000,000,000, and the debtor became the company.
B. On September 5, 2013, Defendant B submitted a report on the right of KRW 5,00,000 of the lease deposit and a request for distribution, asserting that he/she is the lessee of the first floor among the instant housing, and Defendant C submitted an application for the report on the right of KRW 20,000,000 of the lease deposit and the demand for distribution, claiming that he/she is the lessee of the instant housing, among the instant housing, on September 16, 2013. Defendant D submitted an application for the report on the right of KRW 20,000,000 of the lease deposit and the demand for distribution, asserting that he/she is the lessee of KRW 102 of the land of the instant housing on September 16, 2013.
C. On June 13, 2014, the said auction court opened a date of distribution and distributed the amount of KRW 336,891,326 to be actually distributed KRW 20,000, respectively, to the Defendants, in the first order, and set up a distribution schedule (hereinafter “instant distribution schedule”) that distributes the remainder of KRW 276,891,326 to the Plaintiff, who is the mortgagee, as the mortgagee, in the second order.
The Plaintiff appeared on the date of distribution, and stated an objection against the Defendants regarding the whole amount of the first-order dividend to the Defendants, and filed a lawsuit of demurrer against distribution on June 16, 2014.
