1. As to each of the Plaintiffs’ KRW 7,764,193 and each of the above amounts, Defendant D Co., Ltd. from July 7, 2015 to December 22, 2016.

1. In full view of the facts acknowledged as Gap evidence 1 to 6, Eul evidence 3 and 4, each part of Gap evidence 7 and 8, the result of the appraisal commission to appraiser E of this court, the results of fact inquiry, and the whole purport of the pleadings, the following facts are recognized, and each statement of Eul evidence 1 and 2 shall not interfere with the above recognition, and there is no counter-proof otherwise.

The Plaintiffs shared 1/2 shares of each of the instant housing units (hereinafter “instant housing”) with the bricks and cement bricks located in the Seo-gu Daejeon District.

The instant housing was constructed around December 7, 1988.

B. Defendant C is the owner of H lending (hereinafter “instant lending”) on the land of Seo-gu Daejeon, Seo-gu, Daejeon, the immediate adjacent to the instant house, and is between I and the married couple, the representative of Defendant D Co., Ltd (hereinafter “Defendant Co., Ltd”).

C. On August 19, 2014, the Defendant Company received a contract for the new construction of the instant loan from Defendant C with the amount of KRW 937,00,000 for the purchase price, August 22, 2014 on the commencement date, and February 28, 2015 on the completion date, and completed the construction of the said loan.

피고 회사는 2014. 12.경 별도의 흙막이 지보공(버팀대 등)을 사용하지 않는 공법(오픈컷 공법)으로 터파기 공사를 시행하여 흙의 흘러내림을 방지하는 충분한 안식각이 확보되지 못함으로써, 이 사건 주택의 담장이 이 사건 빌라 방향으로 이동하여 위 주택의 담장과 인접 바닥이 1cm 정도 이격되고, 담장 및 담장에 바로 인접한 바닥과 무허가로 증축된 샌드위치판넬 건축물부분(다용도실)에 균열이 발생하게 하였다.

E. As a result of the destruction work by the Defendant Company, 14,116,716 won (excluding value-added tax) is required to cover the cost of repairing defects, such as the fences of the instant house and the cracks in the adjacent floor and sandd position plate buildings.
