The defendant shall be innocent.
Reasons
1. The summary of the facts charged in the instant case is that the Defendant was enrolled in the middle and fourth grade of H University’s humanities and the fourth grade, and was established for the purpose of single and long-term collection by the former Constitution of the Republic of Korea (wholly amended by Act No. 9 of Oct. 27, 1980; hereinafter “new Constitution”), and that the presidential emergency measures for national security and the protection of public order (hereinafter “Emergency Measure No. 9”) were to restrict human rights and the freedom of private teaching institutes.
