Defendant
A and B Imprisonment for six months, Defendant C and D shall be punished by imprisonment for four months.
However, as to the defendant A and B, this paragraph shall apply.
Reasons
Punishment of the crime
1. Defendant A’s identity is a national of the Republic of Korea’s nationality, and Defendant B, Defendant C, and Defendant D are foreigners of Vietnam’s nationality.
2. On November 13, 2011, Defendant A and Defendant B received a request to request that foreigners of Vietnam, who entered Jeju Special Self-Governing Province (hereinafter “Do”) without the visa, enter Jeju Special Self-Governing Province (hereinafter “Do”), who are another region within the territory of the Republic of Korea, move to Busan, without the visa, and consent to the request.
In addition, on November 11, 201, Defendant B promised to receive allowances from a person who received a request to move Vietnamese foreigners who entered Jeju-do without a visa from “H”, who was known to Pyeongtaek-do, to other areas within the territory of the Republic of Korea, to move to Busan-do without a visa.
Although the Defendants entered Jeju-do without a visa and did not move a person who did not obtain the permission of the Minister of Justice for extension of sojourn area to other areas within the territory of the Republic of Korea, the Defendants conspired with G and H respectively, and Defendant B transferred, around November 14, 201, to the Jeju-do passenger ship terminal where Vietnam nationality C and D entered Jeju-do without a visa, a disguised entry of tourists into Jeju-do on November 14, 201, and transferred them to Defendant A. The Defendant purchased the above C and D’s right to embark passenger ships, and was arrested to police officers belonging to Jeju-do Police Agency while moving to other areas within the territory of the Republic of Korea along with them.
Accordingly, the Defendants conspired with the above G and H, and Defendant A tried to collectively move C and D, a foreigner of Vietnam's nationality, who entered Jeju-do without the permission of the Minister of Justice for the extension of the sojourn area, to another area within the territory of the Republic of Korea, but the above purport is not achieved.
