A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

From November 4, 2019 to February 20, 2020, the Defendant, who was working in B from November 4, 2019 to February 2, 202 with no specific address, retired from B due to the problem of wage arrears, and was in mind at around April 2, 2020, to receive wages in arrears.

1. 특수재물손괴 피고인은 2020. 4. 2. 23:10경 위 B 숙소 앞에서, 위 B 숙소에 거주하는 피해자 E 및 F 등에게 출입문을 열어달라고 소란을 피우고 피해자가 출입문을 열어주지 않자, 주택 밖으로 나와 그 인근에 있던 위험한 물건인 블록(가로 40cm, 세로 20cm)을 들고 다시 위 B 숙소 앞으로 간 다음, 위 블록으로 위 B 숙소 출입문에 설치되어 있던 잠금장치를 부숴 수리비 85만 원이 들도록 손괴하였다.

Accordingly, the defendant carried a dangerous block, and destroyed a lock installed at the above B accommodation entrance owned by the victim.

On April 2, 2020, the Defendant, on the grounds of paragraph (1) and (2), was arrested in flagrant offenders and released after being investigated at the Gyeongcheon Police Station around 01:40 on April 3, 2020, and then intruded by again finding the above B accommodation where victims E, victims F (ma, 41 years old), etc. were living at the entrance where locking devices were destroyed and lost their corrective functions, leading to the entry into the dwelling room and the bank. On the grounds that the victim F was pushed down to the entrance where the Defendant was at the entrance, the Defendant opened a new holder door, which was a dangerous article inside the entrance, and unloaded the new door of plastic material, which was a dangerous article inside the entrance, so that 450,000 won for repair costs can be turned down, and the victim F made the victim’s face at the front door and the victim’s face was destroyed by the front door.

Accordingly, the defendant intrudes upon the victims' residence and carries dangerous articles with them.
