A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal history] On July 2, 2008, the Defendant was sentenced to a fine of KRW 1 million as a crime of violating road traffic law (drinking driving) in the Gwangju District Court’s net support on July 2, 2008, and a fine of KRW 7 million as a crime of violating road traffic law (drinking driving) in the Gwangju District Court’s Netcheon Branch on July 30, 2012.

Accordingly, the defendant, who violated the prohibition of drinking at least twice, was driving a motor vehicle under the influence of alcohol in violation of the above provision.
