Punishment of the crime
Defendant
A is a person who works as the representative director of the "F" of the "F" of the real estate sales agency of the 4th 4,084, Gangnam-gu Seoul Metropolitan Government E-building, and Defendant B is a person who has been engaged in the business and company operation affairs, while Defendant B is the head of the same company.
On July 6, 2010, F Co., Ltd. entered into a contract for the entrusted operation of HH welfare store, which is the owner of G School, and agreed that I, who helps to enter into the above contract, leased the first floor of 103 and the third floor B303-2 above the market price, but I refused to do so thereafter, the Defendants notified the company of this fact and carried out the procedure for leasing the above store at a normal price with others, and there was a duty to deposit the proceeds with the company.
Nevertheless, on August 3, 2010, the Defendants, without notifying the company of the foregoing fact, gathered to divide rental profits arising from the sub-lease of the above store, and concluded a lease agreement with Defendant A’s Dong-in, an agent of the above company, to lease lease deposit of KRW 12 million, monthly rent of KRW 100,000, KRW 1000, KRW 303-2, KRW 48,000, KRW 400,000, KRW 400,000, KRW 400,000, monthly rent of KRW 103-2, and the same month.
4. At the same place, 103 above ground level 10,000 won, monthly rent of 4 million won, B303-2 below ground level 30,000 won, monthly rent of 48,000 won, monthly rent of 9 million won to K.
Since September 27, 2010 to April 25, 2012, the Defendants received KRW 13 million per month from K and deposited KRW 5 million in F Co., Ltd., and used the difference of KRW 8 million at will.
As a result, the Defendants conspired to acquire the economic benefits equivalent to KRW 160 million from the difference caused by the sub-lease, and are equivalent to the same amount as the F Co., Ltd.
