피고인은 동명이인의 C 및 그 부인인 D이 피고인을 상대로 대구지방법원 서부지원에 대여금청구의 소를 제기하고 그 증거로서 피고인이 작성한 ‘차용금 증서, 일금:五千五百萬원(오천오백만원정), 상기 금액을 정히 차용한 바 이식은 1.5부 육십만원(600,000원정) 주기로 약정함 2010년 4월 19일로 정합니다 채무자 E에 있는 A 올림, 안집 채권자 D님 귀하’라고 기재된 차용증을 위 법원에 제출하자, 그 차용증이 변조되었음을 주장하기로 마음먹었다.
