A defendant shall be punished by imprisonment with prison labor for up to six months.

Punishment of the crime

그러나 사실, 피고인은 당시 신용 불량자로서 약 2억 원 상당의 채무가 있는 상태에서 피해자 명의로 주유소를 운영하더라도 그 유 류 판매대금은 피고인의 대출금 등 개인 채무 변제, 생활비 등으로 사용할 예정이었으므로 피해자 명의로 SK 네트웍 스로부터 기름을 공급 받더라도 그 외상대금을 변제할 의사나 능력이 없었다.

피고인은 이와 같이 피해자를 기망하여 이에 속은 피해 자로부터 그 무렵 주유소 설립에 필요한 인감 증명서, 인감도 장, 공인 인증서, OTP 카드 등을 교부 받고 이를 이용하여 SGI 서울보증과 이행보증보험계약을 체결한 뒤 2016. 5. 30. 경 SK 네트웍 스로부터 7,000만 원 상당의 유류를 외상으로 공급 받은 후 그 대금을 지급하지 않아 동액 상당의 재산상 이익을 취득하였다.
