1. All of the plaintiff's claims are dismissed.

Basic Facts

The Plaintiff received the claim amount of KRW 24,613,698 in the amount of the claim against the debtor, the Defendant’s land trust company (hereinafter “Defendant”) as the third debtor on June 2, 2009, and the collection order of KRW 244,613,698 (Dasan District Court 2009TTTTTT12190) on June 8, 2009. The above decision was delivered to the Defendant’s land trust with the land trust for the Defendant and finalized on June 8, 2009.

As to the Defendant’s land trust, the case’s proceeds include trust profits on the grounds of the sale-type land trust agreement entered into with Land Development; proceeds from sale in the future; proceeds from construction by money and the amount until the amount reaches the claim amount out of the trust proceeds of the debtor’s land trust; and with respect to the construction of the Defendant Barun, even though the contract entered into with Land Development, the proceeds from sale generated on the grounds of the contract entered into between Land Development and Land Development; proceeds from sale in the future; and all profits accrued after the completion of construction; and proceeds from the settlement of accounts after completion of construction.

On February 21, 201, the Plaintiff and Plaintiff B, who entered into mediation between the Plaintiff and Defendant Nivele Construction, seized the above claim against Defendant Nivele Construction.
