A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date of the final judgment.

Punishment of the crime

No person shall have the other party deliver words, sounds, letters, pictures, images, or other things that may cause a sense of sexual shame or aversion by telephone, mail, computer, or other means of communication, with intent to arouse or satisfy his/her own or the other person's sexual desire.

그럼에도 불구하고 피고인은 2015. 3. 10. 20:49경부터 같은 날 22:28경까지 경북 울진군 C에 있는 ‘D’ 주점 내에서, 피고인의 스마트폰에 설치된 카카오톡 어플리케이션을 이용하여, 이전에 휴대폰을 구입하면서 알게 된 휴대폰 매장 직원이던 피해자 E(여, 17세)의 스마트폰에 “자기야같이자고싶어”, “행복하게해줄게”, “오늘우리같이자자^^사랑해♥^^♥”라는 내용의 메시지를 전송하고, 2015. 3. 20. 21:02경부터 같은 날 22:07경까지 경북 울진군 F에 있는 피고인의 집에서, 같은 방법으로 “전에E씨가물어봤죠 저정말거시기커고예뻐요~정말요”, “애무도 잘해요♥”, “자기랑♥♥♥”, “자기거시기확실하게빨아줄게~~자기줄줄싸게해줄게”, “정말보고싶고같이사랑하고자고싶어요”, “같이자자”라는 내용의 메시지를 전송하였다.

Accordingly, the Defendant, using communication media, sent a text that causes sexual humiliation to the victim with a view to meeting his own sexual desire.
