Reasons
Punishment of the crime
Around October 2007, the Defendant took lectures in the C Research Institute located in Yeongdeungpo-gu Seoul Metropolitan Government, acquired friendship by acquiring the victim D while having been aware of her friendship, and had been developed from around 2008 to resistant relations with the Defendant, as if she had an infinite academic background and had an infinite ability to engage in real estate and distribution business, etc., the Defendant used money from the victim for an uncertain corporate bonds for which the collection of money was received as money for investment, or for an individual purpose, such as repayment of debts.
1. On March 2008, the Defendant made a false statement that “The Defendant borrowed money from the victim’s high-water site located in the Seongbuk-gu, Sung-gu, Sung-gu, Sung-nam, stating that “A small-scale person who operates a factory among those who want to know at home and who need to pay the higher interest if it is needed. I will lend money to that person and receive monthly interest.”
However, even if the defendant receives money from the victim, he did not have the intent or ability to pay the victim interest or profit by investing the money in the factory operator, etc.
As such, the Defendant, by deceiving the victim as such, received from the victim each remittance from the victim to the account in the name of one bank account under the name of his/her father, and acquired KRW 20 million on March 31, 2008, and KRW 10 million on April 18, 2008.
2. The Defendant, around May 2008, made a false statement stating that “The Defendant, in F in Seongbuk-gu, Seongbuk-gu, Sungnam-si, regularly met the faculty of the GJ, and if he supplies it to the factory by developing projects such as productivity improvement and factory automation system, it remains a huge profit if he/she supplies it to the factory, and it remains a profit if he/she makes an investment. It guarantees a high return of profit when investing in the GJ fund, and even if he/she receives a loan, he/she will reduce the monthly profit of KRW 3 million and bear the interest on the loan.”
