The summary of the facts charged is that Defendant A operates and manages a wastewater treatment plant, which is a water pollution prevention facility of the voice branch of D Company, as the head of the Water Quality and Environment Management Team in the Chungcheong-gun C, and Defendant B is a company established for the purpose of water pollution prevention facility project.

Defendant

A wastewater treatment business operator or a person who operates a water pollution prevention facility shall not treat water pollutants discharged from discharging facilities by mixing them with water not discharged during the process or unpolluted water discharged during the process, nor discharge water pollutants by mixing them with water in order to lower the pollution level before water pollutants exceeding the permissible standards for discharge pass through the final discharge outlet of preventive facilities.

피고인은 2015. 7. 22. 14:55 경 충북 음성군 E에 있는 주식회사 D 회사 음성 지점 수질오염방지시설( 폐수처리장 )에서 ‘ 최종 방류 조’ 직전 단계에서 폐수가 통과하는 설비인 ‘ 퍄 살 플 롬 유량계 ’에 수도 호스를 이용하여 상수도 물을 섞어 배출함으로써, 배출 허용기준을 초과하는 수질오염물질이 방지시설의 최종 방류 구를 통과하기 전에 오염도를 낮추기 위하여 물을 섞어 배출하는 행위를 하였다.
