Defendant shall be punished by a fine of KRW 500,000.

Where the defendant fails to pay the above fine, one hundred thousand won shall be one day.

Punishment of the crime

The defendant is the owner of the low-speed car B.

When intending to have a motor vehicle installed, the approval of the competent authority shall be obtained, and no one shall operate the motor vehicle while knowing that it is a motor vehicle which has been installed without obtaining approval therefor.

Nevertheless, on August 2015, the Defendant installed a IMD, which is a light device that did not obtain the approval of the competent authority in the DM in the Gyeongbuk-gun, Gyeongbuk-gun, and installed the IMD to the above vehicle.

Article 2 subparag. 11 of the Motor Vehicle Management Act defines "motor vehicle tubes" as "a partial alteration or addition to a motor vehicle's structure and device," and where the defendant attached a light device under Article 8(2) subparag. 14 of the Enforcement Decree of the Motor Vehicle Management Act, which constitutes a motor vehicle's device and is changed or added, it constitutes a motor vehicle's tubes.

In addition, Article 34 (1) of the Automobile Management Act and Article 55 (1) 2 of the Enforcement Rule of the Automobile Management Act must be approved. According to Article 55 (2) of the Enforcement Rule of the Automobile Management Act, if the structure or device after the misunderstanding fails to meet the safety standards, etc. under Article 29 of the Automobile Management Act, approval shall not be granted, and the latter part of Article 55 (1) of the Enforcement Rule of the Automobile Management Act and the provisions on the Stewardship of automobiles are stipulated.
