A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On November 13, 2020, at around 09:00, the Defendant illegally used the car registration number plates, air, for the purpose of exercising the right by removing the number plates attached to CRIFON 125CC, owned by the Defendant, and attaching them to PR 250CC 250.

2. At around 09:00 on November 13, 2020, the Defendant used the car registration number plate, which is an air hoscule 250CC, with a license plate attached to the “C” at approximately 5 km section from the front of B to the front of E in Busan Dongdong-gu, as described in paragraph 1, from around 00 to the front of E.

3. On Nov. 13, 2020, the Defendant driven the 250CC 2500 on the road from the front side of the Busan Jin-gu, Busan to the front side of the road located in the Busan East-gu, without obtaining a driver’s license, from around 5km section from around 09:0 on November 13, 202.

Summary of Evidence

1. Application of the defendant's statutory statement crackdown photographs, and statutes on the ledger of driver's licenses;

Relevant provisions of the Criminal Act and Articles 238(1) and 238(2) of the Criminal Act (the occupation of unlawful use of official marks and events for the defense of illegally used air) concerning criminal facts, and Articles 152 subparag. 1 and 43 of the Road Traffic Act (the occupation of unlicensed driving, the choice of imprisonment without prison labor);

The grounds for sentencing under the former part of Article 37, Article 38(1)2, Article 50 of the Act on the Suspension of Execution of Article 50, Article 62(1) of the Criminal Act are confessions and reflects against the defendant, the fact that there is no record of crime exceeding the fine against the defendant, and other conditions of sentencing as shown in the records and arguments of this case, such as the defendant's age, sexual behavior, environment, etc., shall be considered and determined as ordered.
