Reasons
1. Details of the disposition;
A. 1) The Defendant is a business area (hereinafter “instant business area”) with the area of 947,868 square meters in Northern-gu Cri, Dri, Eririwon at Port (hereinafter “instant business area”).
2) An urban development project under the replotting method (hereinafter “instant project”)
(2) On December 13, 2013, the Plaintiff is a person who acquired ownership of the shares of 660/12608 square meters out of 12,608 square meters (hereinafter “instant land”) located in the instant project area from the Republic of Korea C&A Co., Ltd. (hereinafter “SA”) on December 13, 2013.
B. 1) On March 29, 2016, the Defendant held a board of representatives to decide on a replotting plan for the instant project and obtained authorization for the replotting plan from the port market on June 23, 2016. 2) The Defendant, in accordance with the aforementioned replotting plan, designated the Plaintiff as the land substitution (hereinafter “instant disposition”) for replotting (hereinafter “instant land substitution”). On June 30, 2016, the Defendant notified the Plaintiff, including the Plaintiff, 1,628 landowners and interested parties within the instant project area, of the designation and public inspection of the land substitution plan with the following contents individually.
(1) On July 22, 2016, when the designation of a planned land substitution takes effect: The public inspection period from July 4, 2016 to July 21, 2016 (excluding Saturdays and Sundays): The place of public inspection from 10:0:0 am to 5:0 am: the office of the defendant's association: the defendant's association requested the Mayor to make a public announcement of the designation and public inspection of the planned land substitution on July 1, 2016, and the defendant made a public announcement of the designation and public inspection of the planned land substitution on July 1, 2016, and the local newspapers (J) within the jurisdiction of the Si/Gun on the same day did not raise any objection during the public inspection period.
