Defendant shall be punished by a fine of KRW 4,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

On June 9, 2016, the Defendant arranged the victim E to purchase a heavy vehicle at a private person D office in the middle-gu building C, Daegu Northern-gu, 205, and to purchase a heavy vehicle at a private person D office in the middle-gu, Daegu-gu, 201, food-based car (F) at KRW 24.9 million.

However, the above difference is due to the defect in the meter board, and the amount of actual purchase was 11.9 million won.

Nevertheless, the Defendant made a false statement to the victim that it is necessary to purchase the above vehicle in order to have 24.9 million won available to the victim for the examination of the loan from Hyundai Capital. After the loan was approved, the Defendant received 24.9 million won from Hyundai Capital to the National Bank account (Account Number H) in the name of G used by the Defendant, and transferred 1.9 million won out of the loan to D with the borrowed purchase price. On June 10, 2016, the Defendant acquired the difference between the loan and the borrowed purchase price by having the victim sign on the borrowed loan-related documents.
