A defendant shall be punished by imprisonment for six months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant of the Gangnam-gu Seoul Metropolitan Government "2019 Highest 7076" is the employer of the employees working in the above company as the representative director of E in Gangnam-gu Seoul Metropolitan Government D.

When a worker dies or retires, an employer shall pay him/her wages, compensations, other money, valuables, and retirement allowances within 14 days after the cause for such payment occurred, unless there exist any special circumstances.

Nevertheless, the Defendant, at the above company from October 15, 2018 to May 31, 2019, did not pay KRW 5,410,052 in total for two employees, including KRW 3,880,227 in total for eight employees, as stated in the list of crimes in the attached Table, including KRW 29,552,414 in total, and KRW 2,379,942 in total for two employees from January 29, 2018 to April 30, 2019, as stated in the list of crimes in attached Table 1, and without any agreement on extension of the payment date between the respective parties, within 14 days from the date on which the cause for payment occurred.

1. When a worker dies or retires, the employer in violation of the Labor Standards Act shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;

Nevertheless, the Defendant is working from January 1, 2018 to June 30, 2019 at the above workplace.

A retired H’s wage of KRW 1,70,060 for December 2018, KRW 3,593,983, monthly wage of March 2019, KRW 3,043,420 for April 2019, and KRW 4,348,310 for May 2019, and KRW 18,471,593 for the total amount of wages of KRW 5,785,520 for June 2019, as indicated in the attached Table 2, did not pay KRW 28,641,110 for retirement workers and I within 14 days from the date of retirement, respectively.

2. An employer who violates the Guarantee of Workers' Retirement Benefits Act shall, in case where the employee dies or retires, within fourteen days after the cause for such payment occurred; and
