피고인은 2014. 12. 21. 경 광주시 이하 불상지에서 스마트 폰이나 컴퓨터를 사용하여 사설 도박사이트 ‘B’ 등에 접속한 후, 위 사이트 운영자가 도박자금 입금계좌로 지정한 유한 회사 애플 컴 명의 SC 제일은행 계좌 (1005560308XXXX )에 50만 원을 입금하여 그에 상응하는 게임 머니를 충전 받고, ‘ 뱅 커 (Banker)' 란 과 ’ 플레이어 (Player)' 란 중 하나를 임의로 선택하여 1회 10만 원에서 100만 원 상당의 금원을 걸고 카드를 분배하는 역할을 하는 ‘ 딜러’ 가 카드 2 장을 뱅커와 플레이어에 번갈아가며 분배한 후 위 카드 2 장의 숫자를 합하여 끝자리 수가 높은 쪽이 승리하면 걸었던 액수 만큼의 게임 머니를 가져가는 방법으로 속칭 ‘ 바카라’ 도박을 수 회하고 남은 사이버 머니를 현금으로 다시 환전하였다.
