The plaintiff is a housing redevelopment and rearrangement project partnership established for the purpose of implementing a housing redevelopment and rearrangement project for approximately 11,000 square meters of land in Jongno-gu Seoul Metropolitan Government, and the defendant is the owner of the building indicated in the attached list located in the above project zone. The plaintiff is authorized by the management and disposal plan concerning the above project (hereinafter referred to as "the above management and disposal plan of this case") from the head of the Gu of Jongno-gu Seoul Metropolitan Government on June 26, 2015 after the resolution of the general meeting of shareholders (hereinafter referred to as "general meeting of this case") on May 23, 2015. The facts notified as Jongno-gu Seoul Metropolitan Government public notice D on July 10, 2015 do not conflict between the parties, or as stated in the evidence No. 1, No. 2-1, No. 2, and No. 48-2 (1) of the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents shall be recognized by the previous public notice of the management and disposal plan, and other land owners.

2. Judgment on the defense

A. As to the summary of the Defendant’s assertion, the Defendant asserted that the instant management and disposition plan was invalid on the ground that it has a serious and obvious defect as follows, and that he/she did not have any ground to respond to the Plaintiff’s claim.

① Before formulating the above management and disposal plan, the Plaintiff, including the Defendant, receives a request for sale from the owners of the land in the above project zone including the Defendant, on November 2014, shall be subject to guidance.
