1. Revocation of a judgment of the first instance;
2. The defendant shall provide the plaintiffs with each real estate listed in the separate sheet Nos. 1, 5 and 7.
Reasons
1. Facts of recognition;
A. On May 30, 1913, Gyeonggi-do 1,024 (hereinafter “K”) around 1,024 square meters (hereinafter “K”) was under circumstances by Z, L 165 square meters (hereinafter “L”) and M 228 square meters (hereinafter “M land”) respectively.
B. Under the former Farmland Reform Act (amended by Act No. 31 of Jun. 21, 194, which was repealed by Act No. 4817 of Dec. 22, 1994; hereinafter “former Farmland Reform Act”), the Defendant purchased 600 square meters from K’s land from N (P), and 128 square meters from L and M’s land from N (O). The prop report prepared at the time of distribution of the said farmland and the prop confirmation log for each of the said lands are written as N (O) with their domicile in the Gyeonggi-do Pakistan-gun.
C. On December 29, 1961, K land was divided into 369 square meters (the real estate listed in paragraph (1) of the attached Table was converted into the area, and became the real estate listed in the attached Table No. 1; hereinafter “1”) and Q. 65 square meters (2,165 square meters after conversion into the area) prior to Q. L was divided into 121 square meters and U.S. 44 square meters on the same day. M was also divided into 115 square meters and 113 square meters prior to Pakistan-gun, Gyeonggi-do on the same day.
After that, TW 121 square meters was divided into TW 104 square meters on September 25, 1962 and V 17 square meters (the real estate stated in paragraph (3) of the attached Table after conversion into the area; hereinafter “third land”). The above TW 104 square meters was divided into the real estate listed in paragraph (2) of the attached Table No. 2 of the attached Table No. 1999 and the real estate listed in paragraph (4) of the attached Table No. 4 (hereinafter “No. 4”).
On the other hand, on September 25, 1962, the 115 square meters prior to the said R was divided into 281 square meters prior to R and the real estate listed in paragraph (6) of the attached Table No. 6 (hereinafter “the 6-land”). The 281 square meters prior to the said R were divided into the real estate listed in paragraph (5) of the attached Table No. 5 (hereinafter “the 5-land”) and the real estate listed in paragraph (7) of the attached Table No. 7 (hereinafter “the 7-land”).
