Defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

Some of the facts charged were revised ex officio to the extent that it does not harm the identity of the facts charged and the defendant's right to defense.

Although the Defendant came to know through the Victim B (Y, 14 years of age) and Pest North Korea, there was no gap between the Defendant and the Defendant, and the victim could not take the Defendant’s desire from the Defendant, who is the Defendant, or other vessels, or from the piracy, on the ground that the Defendant was aware that he was older than himself and was aware of his vessel.

On June 12, 2019, the Defendant asked the victim to “I am,” and asked the victim to “I am, I am, I would like to inform the victim of the defect that “I am, I am, I would like to drink.”

피고인은 같은 날 19:00경 피해자가 그곳으로 오게 되자 피해자와 소주를 먹던 중 한 모금을 먹고 술이 쓰다는 이유로 자신은 먹지 않은 채 피해자에게 소주 한 병을 원샷하도록 하였고, 피해자가 이를 한 번에 먹지 못하자 ‘빨리 먹어라.’고 하여 피해자가 소주 한 병을 다 마시게 한 다음, 술에 취하여 정신을 차리지 못하는 피해자에게 ‘옷을 벗어라.’, ‘씻고 와라.’라고 말하고, 피해자가 씻고 오자 피해자를 침대에 눕게 한 뒤 피해자가 거부하였음에도 피해자의 옷을 모두 벗겼다.

계속하여 피고인은 피해자의 가슴을 만지고, 피해자의 성기에 자신의 성기를 삽입하고 피해자가 아파하면서 ‘하지 말라.’고 하자 “김치년, 걸레년, 뭘 하지 말아.”라고 피해자에게 욕설을 하면서 계속하여 피해자의 성기에 자신의 성기를 삽입하였다.

Then, even though the victim does not refuse to do so, the defendant is able to request the victim to continue to do so, and if the victim refuses to do so, the defendant becomes able to do so.
