1. Defendant A, from around April 8, 2006, as the chairperson of the promotion committee for the establishment of the I Housing Redevelopment Project Association (hereinafter referred to as the “Promotion Committee”) located in the H in Gangnam-gu Seoul Metropolitan Government (hereinafter referred to as the “Promotion Committee”), Defendant A, as the head of the I Housing Redevelopment Project Association (hereinafter referred to as the “Union”) from around May 29, 2009, was in charge of the overall affairs related to the Housing Redevelopment Project. A.
(1) Around May 2009, the Defendant: (a) at the office of the committee of promoters located in Gangnam-gu Seoul Special Metropolitan City, the head of the promotion committee; (b) while having been in charge of the overall duties related to the housing redevelopment improvement project as seen above, the Defendant, as the head of the promotion committee, was holding a general meeting for the purpose of meeting on May 29, 2009 to resolve the Defendant’s dismissal; (c) around May 21, 2009, the Seoul Northern District Court applied for the prohibition of holding a general meeting to the effect that “it shall not hold a general meeting for the purpose of meeting to dismiss the promotion committee member; (d) paid the Defendant’s attorney fees of KRW 10 million to the Defendant’s attorney; and (e) when the above general meeting was held on May 29, 2009 due to the rejection of the above provisional disposition, he voluntarily applied for the suspension of appointment of the Defendant’s individual attorney’s dismissal under the name of “the Minister of Justice’s dismissal of the promotion committee.”
(2) On March 2, 2011, the Defendant, at a partnership office located in Gangnam-gu Seoul Metropolitan Government H around March 2, 201, is the president of the partnership, while maintaining the property of the association for the sake of the victim partnership while taking overall charge of the housing redevelopment improvement project as above.
