The defendant is a person who resides on the upper floor of an apartment house in which the victim C (math, 78 years of age) resides.

피고인은 2014. 8. 15. 10:50경 양산시 D아파트 204동 3-4라인 입구에서 평소 층간 소음 등으로 감정이 좋지 않은 피해자가 담배를 피우기 위하여 밖으로 나오면서 마주치자 “뭘 쳐다 보노”, “육십 여덟 먹은 놈이 팔십이라고 거짓말 하노”라고 하면서 시비하자 피해자가 “멱살만 잡아도 요즘에 벌금 100만 원이다”라고 하자 이에 화가 나 피해자를 밀어 넘어뜨리고, 재차 일어난 피해자의 멱살을 잡고 주먹으로 얼굴 부위를 1대 때리는 등 폭행하였다.
