1. The plaintiffs' claims against the defendants are all dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Basic facts
A. On April 10, 1980, a building with one story underground and three story above ground was completed on the ground of 738.9 square meters in Jung-gu Seoul, Jung-gu, Seoul, and on May 13, 1980, a building with one story underground and three story above ground was completed on the ground of 3,002 square meters above the ground.
(2) Each of the above sites is "each of the above lands", and each of the above buildings is "D" and "E commercial buildings of this case" in sequence, and each of the above buildings is "each of the above buildings" (hereinafter "each of the above buildings"). B.
At the time of the new construction of each shop of this case, the owners of each shop of this case established the plaintiff A for the management of the said shop, and thereafter the plaintiff A was actually operated as the management body of each shop of this case.
C. Each of the instant commercial buildings has been registered as a sectional owner with respect to each of the stores which are sections for exclusive use from the time of the first sale to the date of the sale, but the registration of ownership transfer with respect to each of the instant buildings is limited to the site according to the ratio of the area of the section for exclusive use of the stores for exclusive use. Each of the instant buildings is unregistered as a site for each of the instant commercial buildings.
Plaintiff
B is the owner of No. 177 of the first floor among the instant D stores, and Plaintiff C is the owner of No. 26 of the third floor among the instant E stores.
E. On February 7, 2012, Plaintiff A filed an application with the head of Jung-gu Seoul Metropolitan Government (hereinafter “the head of Jung-gu”) for permission to extend three-story sales facilities (market and management office) of 1,126.46 square meters on the relevant rooftop in the name of “F and 120 persons,” and to repair the stairs rooms from the first floor to the third floor as special escape stairs in the name of “G and 353 persons,” respectively, for permission to expand the sales facilities of 2,512.5 square meters on the relevant rooftop and to repair the stairs rooms from the first floor to the third floor as special escape stairs.
