1. The Plaintiff:
A. As regards the Defendant C’s KRW 113,00,000 and KRW 95,000 among them, Defendant C shall be from January 30, 2016 to 18,000.
Reasons
1. Facts of recognition;
A. 1) Defendant B is a person running real estate brokerage business under the trade name “E Licensed Real Estate Agent Office” in Nam-gu, Nam-gu. 2) The Defendant Association concluded a mutual aid agreement with the parties to a transaction as a juristic person established for the purpose of implementing mutual aid projects, etc. for licensed real estate agents; Defendant B, a licensed real estate agent, and the amount of deduction KRW 100 million; and the period of deduction from October 8, 2015 to October 7, 2016, where the parties are liable to compensate for damage under the Licensed Real Estate Agent Act due to intentional or negligent conduct of real estate brokerage (hereinafter “instant mutual aid agreement”).
3) F and G constitute “instant apartment” (hereinafter referred to as “instant apartment”) of the Nam-gu H apartment 401, Nam-gu, Nam-gu, Sinpo-si.
B) Co-owners are co-owners. B. 1) In the process of finding the real estate to be leased by the Plaintiff, the Plaintiff was introduced I registered as a brokerage assistant of the E Licensed Real Estate Agent Office.
2) The Plaintiff, along with I, did not reach a lease agreement, but I introduced Defendant C to the Plaintiff side. At the time, Defendant C was using the name of the representative of the E Licensed Real Estate Agent Office. 3) The Plaintiff visited the instant apartment that was introduced by Defendant C and confirmed that the apartment was undeveloped with Defendant C.
On January 13, 2016, J, representing the Plaintiff, drafted a lease agreement (hereinafter “instant lease agreement”) stating that the instant apartment is leased at the E Licensed Real Estate Agent Office KRW 120 million (a down to KRW 32 million, a balance of KRW 88 million), from January 29, 2016 to January 28, 2018, and the name of Defendant B was entered in the said lease agreement as a practicing licensed real estate agent.
4. The J shall prepare the instant lease agreement at the request of Defendant C.
