The prosecutor's appeal is dismissed.

1. The summary of the grounds for appeal that the court below sentenced the defendant (nine months of imprisonment) is too unhued and unfair.

2. In full view of the following circumstances: (a) the Defendant did not agree with the victim; (b) the Defendant was unable to fully repay the amount of damage; (c) the Defendant led to confession and reflected the instant crime; and (d) the victim recovered USD 5,760 from the Defendant; and (c) the Defendant’s age, character and conduct, the motive, means and consequence of the instant crime; and (d) the circumstances after the commission of the crime, etc., the sentence of the lower court is too unreasonable

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the ground that it is without merit. It is so decided as per Disposition.
