Defendant
A shall be punished by imprisonment with prison labor for up to 10 months, and shall be punished by imprisonment for up to 6 months with prison labor for a crime of "2016 senior group 1850".
Reasons
Punishment of the crime
1. Defendant A, “2015 Highest 3890, the Defendant, refers to a person who attends as the head of G Co., Ltd.’s aviation business.
The defendant, in collusion with the representative director B of the above G, stated that "the defendant would purchase and lease a helicopter" to the victim at the J office in the Gangseo-gu Seoul Metropolitan Government H operation of the victim I around October 201, and received two million won from the victim on November 9, 201, as the equipment for the purchase of the helicopter, and on December 15, 2011, at the above J office, "the defendant would purchase two helicopters and lease the helicopters to the victim on December 16, 201," and received six million won from the victim on December 16, 201, as the equipment for the purchase of helicopter rent, 58,030,000 won as the equipment for the lease of helicopter rent on December 23, 2011, from the victim on December 16, 2011.
However, in fact, the contract for the purchase of Mai-2 helicopter from K, U.S., U.S. at around that time, was reversed as the payment of the purchase price by the Defendant’s side. Ultimately, the above Mi-2 helicopter was sold in Korea L, and the Defendant used the money received from the injured party for other businesses not related to the purchase of helicopter, and the Defendant did not have any intent or ability to lease the said money to the victim by purchasing the helicopter.
Accordingly, the Defendant conspired with B to induce the victim and received 66,030,000 won in total from the injured party.
2. On December 27, 2012, Defendant B was sentenced to imprisonment with prison labor for a violation of the Act on the Law of Defense at the Seoul Northern District Court on March 14, 201, and the sentence became final and conclusive on March 14, 2013, and the execution of the sentence was completed at an Ansan Prison on December 26, 2012.
The defendant of "2016 Senior 1850" is the representative director of G Co., Ltd.
The defendant permits A to use the position of the head of the above G's aviation project headquarters, and A around October 201, at the J Office Co., Ltd., a helicopter located in Gangseo-gu Seoul Metropolitan Government H victim I in Gangseo-gu, Seoul, the victim purchased the helicopter from abroad.
