1. On July 29, 2012, the Defendant, as a bad credit holder, was in short of living expenses due to accumulated debts. On July 29, 2012, the Defendant had been aware of the victim E (34 years old) with insufficient intelligence in the soup bank of “D” located in Busan Dong-gu, Busan, with a view to making money by means of issuing mobile phones and credit cards or using them for loans under his/her name.

On July 30, 2012, the Defendant: (a) opened a mobile phone; (b) opened the mobile phone in Busan Jung-gu, Busan; (c) opened the mobile phone; (d) opened the mobile phone; (c) opened the mobile phone; and (d) opened the mobile phone with the intent or ability to pay the purchase price to another person; (d) informed the victim E who lacks the intent or ability to pay the purchase price; (e) made the method of preparing an application for subscription to the mobile phone; and (e) had the victim prepare an application for subscription at the said agency. Accordingly, the Defendant, who believed that the victim was able to pay the purchase price of the mobile phone normally while opening the mobile phone; and (e) received two mobile phoness of the total price of KRW 1,860,00 (one KRW 930,000 per unit); and (e) by deceiving the above sales member; and (e) by inducing the victim to incur property damage equivalent to the above 1,860,000 won under his/her name; and (e.g., 2000 of his/her property damage.
