1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. The Plaintiff is a resident who resides in B Apartment-dong 202 Dong 501 (hereinafter “instant apartment”).
B. On December 16, 2014, the Defendant, as the 270 household unit, publicly announced a notice of hearing of residents’ opinions to conclude a renewal contract with the housing management operator of the instant apartment on the bulletin board of each Dong library of the instant apartment (hereinafter “instant public notice”). The main contents are as follows.
1. If at least 1/10 of the occupants, etc. do not request in writing the occupants, etc. to replace a housing management operator or to change management methods by hearing their opinions in advance, the contract shall be renewed with the consent of at least 2/3 of the members of the council
(Article 52(4) of the Enforcement Decree of the Housing Act; 2. The date the contract period expires: C: Housing management operator whose contract period expires on February 28, 2015:

(a) Preparing a form on which the official seal of the council of occupants' representatives is affixed, and visiting the householder and his/her agent directly and individually to submit it (no copy, duplicate, and official seal of one household shall be valid);
(b) If the person is not the householder (limited to the person living together) and directly submit an agent to the management office, accompanied by a power of attorney.
(c)The objection and the power of attorney form shall be kept in the management office and shall not be used in other forms.

C. On December 25, 2014, the Plaintiff copied one original copy of the objection received from the Defendant, and signed or sealed by the 49 household occupants of the instant apartment on the copy, and signed and sealed by the Plaintiff on the original copy of the objection, and was present to the Defendant as the housing management operator of the instant apartment on December 25, 2014.
