The defendant shall have 14 movables in attached list 1 and 6 movables in attached list 2 from the plaintiff.
Reasons
1. Basic facts
A. The Plaintiff is a person who operates a personal business with the trade name of “C” and “D”.
B. In light of the electromagnetic absorption and emissions products produced and supplied by the Defendant on June 28, 2018, the Plaintiff appears to refer to the type of bedclothes, attached to a kitchen, among the type of bedclothess produced by the Defendant, that is, be used by connecting a license line on the part of the container in the building, in light of the contents of the records and pleadings of the instant products produced and supplied by the Defendant. The term “the instant agreement” refers to the Plaintiff’s business agreement with a domestic exclusive sales right for five years (hereinafter “the instant agreement”).
The main contents are as follows. For the convenience of the Work Agreement (Evidence A), “A” refers to the Defendant and “B” as the representative of “(tentatively named) G, but the following trade name was determined as “C”. Article 1 / [Purpose] the Defendant manufactures the products consulted upon pursuant to the Plaintiff’s opinion, supplies them in a stable manner, and sells them to consumers, thereby promoting mutual interests and development. A. The Plaintiff has the right to sell domestically the absorption and emission products supplied by the Defendant.
(b)the composition, specification, and unit price of all products shall be subject to a separate agreement;
Article 4 (Contract Terms and Termination)
(a)The duration of this Convention shall be five years from the date of its conclusion, and shall be automatically extended unless there is any mutual objection;
B. The Defendant and the Plaintiff may terminate this contract with a written notice immediately when the occurrence of a serious cause attributable to the degree that it is difficult to conduct the business.
Article 5 [Damages] The defendant or the plaintiff suffers from the failure of either party to perform his/her duty under this Agreement to the other party to the transaction.
