A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. On April 20, 201, the Defendant made a false statement to the victim E, who had returned from the rest area in Geumsan-gun C, Geumsan-gun, that “The Defendant would pay the Handphone fee, because the Defendant had no money to pay the Handphone fee, and the face of the card is to pay the card price immediately.”

However, even if the card was used, there was no intention or ability to pay the price.

The Defendant, by deceiving the victim, obtained a new card from the victim’s name, and used 8,051,300 won in total over 14 times, such as the statement in the crime inundation (1), from June 29, 2011.

2. Around April 27, 2011, the Defendant made a false statement to the victim, at the same place as the preceding paragraph, stating, “If the Defendant borrowed another card, which would not be used as an excess of the limit, it would be paid immediately.”

However, even if the card was used, there was no intention or ability to pay the price.

The Defendant, by deceiving the victim, received the Samsung Card in the name of the victim and oneSK Card from the victim to June 28, 201, and used the Samsung Card totaling KRW 1,307,510 over six times from the date on which it was entered in the annexed crime list (2) from June 28, 2011, and used one SK Card totaling KRW 19,271,517 over 17 times from May 5, 201 to June 27, 2011.

3. On May 11, 201, the Defendant made a false statement that “The Defendant would lend money to the victim, and even if he/she fails to do so, he/she will make a full payment.”

However, there was no intention or ability to repay the money even if the money was borrowed.

As such, the Defendant, by deceiving the victim, received the Agricultural Cooperative Cash Card from the victim on his/her job, and withdrawn KRW 2 million on the same day, and withdrawn it on the 13th of the same month.
