1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

On May 15, 2015, the Defendant filed an application for a payment order with B Company as Seoul Central District Court No. 2015 tea1157, and the above court issued and confirmed the payment order as it is. On May 15, 2015, the enforcement officer affiliated with Sungwon District Court Sungnam Branch Branch Branched the above payment order with the executory exemplification of the payment order finalized upon the Defendant’s delegation, which is the creditor, issued a seizure execution (hereinafter “instant seizure execution”) against each of the movables listed in the attached attachment attachment list (hereinafter “each of the instant movables”), which was located in Sungnam-gu C and the second floor 203, and the fact that D, one of the co-representatives of B Company B, participated in the execution procedure of the instant seizure execution, is acknowledged by the entire purport of pleadings as a whole.

2. The assertion and judgment

A. The Plaintiff’s gist of the Plaintiff’s assertion argues that the instant movable property is owned by the Plaintiff, and that the instant movable property is owned by the Plaintiff, and that the enforcement of each of the instant movable property should be denied, on the grounds that: (a) the Plaintiff lent KRW 24,00,000 to B Co., Ltd. over several occasions on January 15, 2014 and around December 2014; (b) the Plaintiff acquired the right to refund KRW 10,00,000 from B Co., Ltd. on January 15, 2015 as to KRW 10,000,000 as to KRW 20,00 from Sungnam-si, Sungnam-si, 203; and (c) on April 24, 2015, the Plaintiff acquired each of the instant movable property kept

B. The transfer of the real right to the movable property becomes effective upon delivery of the movable property (Article 188(1) of the Civil Act). D and the Plaintiff jointly operated by Company B, drafted a lease deposit return claim against Company C and 203 in Sungnam-si, Sungnam-si, and the Plaintiff, and a contract for transfer or takeover to transfer each of the instant movable property. D are one of the joint representative directors of Company B, and D jointly operated on May 15, 2015, and the Plaintiff, Sungnam-si, Sungnam-si, and 203, respectively.
