A defendant shall be punished by imprisonment for not less than eight months.

An application for compensation by an applicant for compensation shall be dismissed.

Punishment of the crime

Around August 21, 2014, the Defendant stated that “Around August 21, 2014, the Defendant shall pay the victim D the profits from the purchase of commercial buildings at KRW 18 million, if he/she lends KRW 9 million to the victim D while he/she intends to purchase a nearby shopping district,” and issued a note at the notary public F office of the fourth floor of the building in Gangdong-gu Seoul Metropolitan Government, 200,000 won for bills to the victim and the due date on September 21, 2014.” On the following day, the Defendant issued one promissory note, which was issued on September 21, 2014, to the victim.

However, even if the defendant borrowed money from the victim, he was thought to use it for the purpose of the repayment of personal debt, and he did not have the intent or ability to repay 18 million won to the victim by investing it in purchase.

On August 21, 2014, the Defendant received from the victim the transfer of KRW 9 million from the victim to the Suhyup (G) account under the name of the Defendant and acquired it.

On July 14, 2014, the defendant of "2015 Man-Ma897" stated that "the defendant would be allowed to participate in an auction because he/she has been interested in the land of fine, and there is an I auction building in Bupyeong-gu, Nowon-gu, Seoul. In order to proceed with an auction, he/she need to pay expenses for conducting an auction."

However, in fact, the auction did not proceed in the above building, and the defendant did not have the intention or ability to proceed with the auction.

The defendant, as described in the attached list of crimes, deceiving the victim as such, received KRW 10 million from the victim under the pretext of the progress of the auction on the same day, and the same year from that time as shown in the attached list of crimes.

8.8. Not later than seven times in total, obtained a total of KRW 31.6 million and acquired it by fraud.
