피고인은 2012. 6. 10. 01:25경 춘천시 C마트'앞 공원에서, 피해자 D(20세), E(21세)이 술을 마시던 중 피고인에게 “꺼지라”고 하였다는 이유로 피해자 D과 서로 멱살을 잡아 땅바닥에 넘어져 뒹굴고 넘어진 D의 얼굴을 주먹으로 수회, 발로 가슴부위를 수회 걷어차고, 다시 주먹으로 어깨부위를 수회 때렸다,
