Facts of recognition
H completed the registration of ownership transfer on the ground of donation made on March 8, 1948 on April 17, 1981 with respect to G orchard 3,818 square meters (hereinafter “instant real estate”).
Defendant E Village Association completed the registration of preservation of ownership on August 12, 1981, on the ground of (a) part of 103 square meters in the ship connecting each point of (a) [Attachment 1 through 6, and 1] of the instant real estate (hereinafter “instant warehouse site”) and on the ground of 103 square meters in the annexed drawings (hereinafter “instant warehouse site”).
H의 아들인 피고 F은 1983년 무렵 이 사건 부동산 중 별지 도면 표시 ㄱ~ㅎ, ㄱ의 각 점을 차례로 연결한 선내 (나) 부분 100㎡ 지상에 무허가 주택을, 이 사건 부동산 중 별지 도면 표시 6, 7, 8, 5, 6의 각 점을 차례로 연결한 선내 (다) 부분 19㎡ 지상에 무허가 창고(이하 위 무허가 주택과 창고를 합쳐 ‘이 사건 주택’이라 하고, 그 부지를 ‘이 사건 주택부지’라 한다)를 건축하고, 1984. 12. 7. 이 사건 부동산에 관하여 1984. 11. 29.자 매매를 원인으로 하는 소유권이전등기를 마쳤다.
I purchased the instant real estate in a compulsory auction procedure on June 29, 199 and acquired its ownership.
On March 16, 2016, the Plaintiffs, who are children of I, completed the registration of transfer of shares based on the gift made on February 29, 2016, with respect to one fourth share of the instant real estate.
[Unless there exists any special circumstance, Defendant E Village Association has the warehouse of this case on the ground of the real estate owned by the Plaintiffs, and Defendant E Village Association removed the warehouse of this case to the Plaintiffs, barring any special circumstance. The court below erred by misapprehending the legal principles on the following facts: (a) Gap's evidence 1 to 3, Eul's evidence 1, Eul's evidence 1 to 3, Eul's evidence 1 to 1, Eul's whole purport of the arguments, and the plaintiffs' whole purport of the arguments.
