1. The Defendant shall pay to the Plaintiff KRW 46,00,000 and the interest rate of KRW 15% per annum from September 29, 2016 to the day of complete payment.

1. Basic facts

A. On March 23, 2012, the Dondi City Development Co., Ltd. (hereinafter “Execution Company”) entered into a sale management trust agreement and business agreement and agency agreement with the International Trust Co., Ltd. (hereinafter “Trust”) while carrying out the business of selling DNA officetels built on the land outside Gwangju Seo-gu, Seo-gu, and four parcels, a company for the execution of the Dondi City Development Co., Ltd. and the Gaman Construction Co., Ltd., Ltd., for the ownership of the executor., and changing the trade name to the International Trust Co., Ltd. (hereinafter “International Asset Trust Co., Ltd.”).

The main contents are as follows: ① a trust company manages the ownership of an officetel business site; ② an officetel ownership is also managed by a trust company when an officetel is newly constructed and registered for preservation; ② an event is held by a trust company; ② a trust company is recorded and sealed as a trust company; ③ the first printed new sale contract is managed and kept by a trust company; ④ a trust company is issued after the issuance of a new sale contract; ④ the sale price must be deposited into the management account opened by the trust company; ④ the sale price must be deposited into the management account opened by the trust company; ④ the sale price must be deposited into the management account opened by the trust company; and the payment for sale should not be deposited into the designated fund management account; ⑤ the sale contract without the seal of the trust company does not become effective.

B. On March 23, 2012, the trust company completed the registration procedure for transfer of ownership based on the trust regarding the entire project site of an officetel. The registration for transfer of ownership in the name of the executor was completed on September 14, 2015 due to the entrustment of registration pursuant to the decision on provisional disposition requested by the Defendant (hereinafter “instant officetel”). The registration for transfer of ownership in the name of the executor’s office was completed on September 14, 2015, and with respect to the instant officetel on October 5, 2015.
