1. C Co., Ltd, D Co., Ltd, E Co., Ltd, F Co., Ltd., F Co., Ltd., G Co., Ltd., and H. on April 1, 2015.

Basic Facts

On April 1, 2014, pursuant to Article 14(1) of the Monopoly Regulation and Fair Trade Act (hereinafter “Fair Trade Act”), the Defendant designated 26 affiliates, including Plaintiff B, C, D, E, E, F, G, H Co., Ltd., and J Co., Ltd. (hereinafter “Plaintiff B”), D, D, E, F, and H Co., Ltd., and J Co., Ltd., and “E,” “E,” “H”, “H”, “I”, “J”, and “J” as to the remaining eight affiliates, including the Plaintiff B, and notified the Plaintiff of the designation of 26 affiliates, including the same person as the Plaintiff.

(2) On April 1, 2015, pursuant to Article 14(1) of the Fair Trade Act, the Defendant designated and notified 26 affiliates, including Plaintiff B, C, D, E, F, G, H, I, and J, as K of an enterprise group having the same person as Plaintiff A (hereinafter “instant Disposition 2”), and combined with the instant Disposition 1, “each of the instant dispositions”.

(2) As of April 2014, the current status of the enterprise group K and C is as follows: (a) as of KRW 17:37 billion in total assets of 26 affiliated companies; (b) approximately KRW 18:21 billion in total sales; and (c) KRW 18:8,28 billion in total assets of 26 affiliated companies; and (b) KRW 16:8,35 billion in total sales; and (c) Plaintiff B is liable to collect and publish the disclosures of the company belonging to the enterprise group, as “representative company of the enterprise group” of the enterprise group, and to prepare matters difficult to prepare by the individual company.

3) As of April 2014 and April 2015, the current status of shareholder ownership (excluding preferential ownership) in C with respect to each shareholder is as listed below. The current status of shareholder ownership (based on April 2014) (based on the same person as of April 2015) is the spouse of a relative of 0.00% 0.00% per the same person’s shareholding ratio of the number of shares in relation to the same person as of April 2015.
