A defendant shall be punished by imprisonment for a term of one year and two months.
An application filed by an applicant for compensation shall be dismissed.
Reasons
Punishment of the crime
1. On May 3, 2015, at night, the Defendant: (a) intruded the victim E with the F loan gate, in which the victim E is living in Seo-gu Daejeon-gu, Daejeon; (b) committed a theft with one bicycle equal to KRW 1.50,00,00 in the market price owned by the victim on the one-story floor; and (c) habitually, from around that time to June 4, 2015, the Defendant attempted to steal or steal the victim’s property owned by the victims on a total of 37 occasions, such as the list of crimes in attached Table 1.
2. On May 28, 2015, the Defendant acquired one 100,000 won of the market price at which the victim G was lost on the front of the entrance of the suspendam market located in Daejeon-dong, Daejeon-ro 46, a new card, a lot card, one card, and one NANH body card, etc. were included.
The Defendant, without taking necessary procedures such as returning the acquired property to the victim, embezzled the property he/she had on his/her own mind.
3. On May 28, 2015, the Defendant, at around 03:46, presented the “J” in the “J” operation of the victim I located in Daejeon-dong, Daejeon-gu, that the Defendant would purchase one cigarette by suggesting that the Defendant would purchase the new card obtained as stated in paragraph 2 as the Defendant’s credit card.
However, the defendant was not the owner or the legitimate holder of the above credit card, and there was no intention or ability to pay the price even if he purchased the tobacco.
Around that time, the Defendant, by deceiving the victim, received tobacco 1,500 won at the market price of 4,500 won from the victim, by deceiving the victim as such, and then received goods from the victims or acquired property gains through a total of eight times as shown in the attached Table 2 of Crimes List 2.
4. The Defendant violated the Specialized Credit Financial Business Act, at the same time, at the same time and place as Paragraph 3, presented a credit card and signed a sales slip and used the lost credit card.
