Reasons
Punishment of the crime
[criminal power] On April 2, 2009, the Defendant was sentenced to one year and six months of imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes and two years of suspension of execution, and on May 28, 2009, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes and was sentenced to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes, and on April 13, 2011, the same court was sentenced to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes, and on September 29, 2016, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes and on November 21, 2018.
【Criminal Facts】
1. Violation of the Aggravated Punishment Act;
A. On December 11, 2018, at around 02:45, the Defendant: (a) opened a door of a vehicle not corrected for the DK5 vehicle owned by the injured party C, which was parked at the 02:5 Gwangju Northern-gu B parking lot; and (b) cut off with one smart key owned by the injured party, one cash, and three hundred thousand won.
B. At around 03:00 on December 17, 2018, the Defendant: (a) opened a door of a non-Correctioned vehicle for the G-5 car owned by the victim F, which was parked in the roads located in Gwangju Northern-gu; and (b) continued to collect one passbook from the victim’s H bank owned by the victim, and withdrawn KRW 1,10,000 in total seven times in total in the same manner as the list of crimes in attached Table 1, in the cash withdrawal period established on the first floor of the J bank located in Gwangju Northern-gu, Gwangju, and then withdrawn KRW 300,000 by entering the password on the back of the passbook; and (c) subsequently, the Defendant collected KRW 1,10,000 in total at seven times in the same manner as the list of crimes in attached Table 1.
C. On December 30, 2018, at around 00:59, the Defendant opened a door of a vehicle not corrected for a passenger car owned by the injured party LMW520D, which is parked at the apartment parking lot in the North-gu, Gwangju, North-gu, Gwangju, and entered the door, and was in the vehicle.
